Welcome to Pixplain. These Terms of Service ("Terms") govern your use of the Pixplain mobile application and related services (collectively, the "Service") operated by Pixplain ("we", "our", or "us").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Description of Service

Pixplain is a visual-first spaced repetition learning application that uses artificial intelligence to:

• Generate flashcards from content you provide (PDFs, photos, web links, YouTube videos)
• Create educational infographics to enhance visual learning
• Track your study progress using spaced repetition algorithms
• Personalize content based on your learning preferences

2. User Accounts

2.1 Account Creation

To use Pixplain, you must create an account using your email address or through Google or Apple sign-in. You must provide accurate and complete information and keep your account credentials secure.

2.2 Account Responsibility

You are responsible for all activity that occurs under your account. You must notify us immediately of any unauthorized access or security breach. We are not liable for any loss or damage arising from your failure to protect your account.

2.3 Age Requirements

You must be at least 13 years old to use Pixplain. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

3. User Content

3.1 Your Content

You retain ownership of content you create or upload to Pixplain, including flashcards, PDFs, and photos ("User Content"). By using the Service, you grant us a limited, non-exclusive license to process, store, and display your User Content solely for the purpose of providing the Service to you.

3.2 Content Responsibility

You are solely responsible for your User Content. You represent and warrant that:

• You own or have the right to use any content you upload
• Your content does not infringe on any third party's intellectual property rights
• Your content does not violate any applicable laws or regulations
• Your content does not contain malware, viruses, or harmful code

3.3 AI-Generated Content

Content generated by our AI (including flashcard questions, answers, and infographics) is provided "as is" for educational purposes. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying any AI-generated content before relying on it.

4. Subscriptions and Billing

4.1 Free and Paid Tiers

Pixplain offers a free tier with limited features and paid subscription tiers (Pro and Ultimate) with enhanced capabilities. Features and credit limits for each tier are described in the app.

4.2 Subscription Terms

Paid subscriptions are billed through Apple's App Store. By subscribing, you agree to:

• Pay the applicable subscription fees
• Automatic renewal at the end of each billing period
• Apple's terms and conditions for in-app purchases

4.3 Cancellation

You may cancel your subscription at any time through your Apple ID settings. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial billing periods, except as required by law.

4.4 Price Changes

We may change subscription prices with reasonable notice. Price changes will apply to subsequent billing periods after the change is announced.

5. Acceptable Use

When using Pixplain, you agree not to:

• Violate any applicable laws or regulations
• Infringe on others' intellectual property or privacy rights
• Upload content that is illegal, harmful, threatening, abusive, or otherwise objectionable
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use the Service to distribute spam or malware
• Reverse engineer, decompile, or attempt to extract the source code of the app
• Use automated systems or bots to access the Service
• Circumvent or manipulate credit limits or subscription restrictions
• Resell or redistribute the Service without authorization

6. Intellectual Property

6.1 Our Rights

Pixplain and its original content, features, and functionality are owned by us and are protected by international copyright, trademark, and other intellectual property laws. This includes our name, logo, app design, and underlying technology.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial educational purposes, subject to these Terms.

7. Third-Party Services

Pixplain integrates with third-party services including Clerk (authentication), Convex (database), OpenRouter and Google (AI processing), and RevenueCat (subscriptions). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services.

8. Disclaimers

8.1 Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We may modify, suspend, or discontinue any part of the Service at any time without notice.

8.2 Educational Content

Pixplain is a study aid and not a substitute for formal education, professional advice, or authoritative sources. AI-generated content is provided for educational purposes only and may contain inaccuracies. Always verify important information from authoritative sources.

8.3 No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $50 USD, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless Pixplain, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms.

11. Termination

11.1 By You

You may terminate your account at any time by deleting your account through the app settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11.2 By Us

We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. We will make reasonable efforts to notify you before termination unless immediate action is required.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting a notice in the app or sending you an email. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

13. General Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Pixplain regarding the Service.

13.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

13.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

13.4 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
